Copyright Issues

When it comes to material that you have designed and spent a great deal of time on, it is normally something that is very important to you, and you would like to have the assurance of knowing that it is protected. Making sure to have your material protected by having it copyrighted can be an important step in seeing that no one will be able to take what is yours. However, there can be many different copyright issues you could run into. It would be very beneficial to you, to stay up-to-date on all copyright rules and guidelines.

Copyright Infringement is of course one of the major issues that can come up with any type of copyright is involved. When someone uses another person's material that has been protected by a copyright, in such a manner that the owner's original exclusive rights have been violated.

When it comes to electronic or audio-visual media, copyright infringements on these items are sometimes called piracy or theft. There is also the chance that materials not copyrighted will be used unfairly and there would be little the creator can do to stop the use until they copyright their creation.

When it comes to copyright expiration, pertaining to text that has been published, here are some guide-lines:

Anything published before 1923 is no longer copyright protected unless another person has since filed for a copyright to protect the work and obtained it from the U.S. Copyright Office. If the copyright is not renewed by a family member or other person who has a right to place the copyright the work then becomes available for anyone to use or change as they wish to use it for.

From 1923thru1963 these that were copyrighted items are still protected, as long as the copyright has been renewed. On these earlier works should they never have held a copyright one can be issued for them when the proper papers are filled out along with two copies of the work and sent to the United States Copyright Office. This is often done by family members after the passing of the creator of the work, they feel that not only to keep others from claiming this work as their own the family wants to give this deceased family member a legacy. A legacy it is as the copyright once issued will be in force for seventy-five years.

From 1964 until today the work that a copyright has been placed on is still protected by its original copyright.

Another thing that is very important and one that can be very frustrating to many individuals would be copyright forms that need to be filled out. If these forms are not done correctly, it can become very frustrating, causing a delay in getting your important material you've created, copyright protected. It is possible that it can end with the U.S. Copyright Office returning your application and materials if everything is not properly filled out on the application, if your materials to be copyrighted are not in the same package or your payment is not attached.
