Legal protection can be denied with these types of trademarks as proving infringement would be a close to impossible task, since it consists of commonly used terms. The main purpose of a distinctive trademark is for the reaction of customers. So a trademark can generally only be registered if consumers have not heard of it before. Owners looking to get there trademark registered should consider all aspects and know what they need to do in order for that trademark to be accepted by the Patent and Trademark Office.
