By hiring a patent lawyer they can also inform you of the step-by-step process you are about to go through. They have the best knowledge in the field to help you get the design or logo you want and thoroughly search through trademarks in order to have the best chance of not being rejected and sent back from the Patent and Trademark Office.

Of course there is another way if you don't want to spend a bunch of money on a lawyer. You can do the research and searches yourself. Though there is not an actual free trademark search site, there are a few secondary sites you can search free of charge. Even with using these sites, you will still need to do a considerable amount of research before you can be assured if your trademark is available.

The first site is the United States Patent and Trademark Office. Though they do have there own site where you can perform searches for federal trademarks, their databases are not complete. You cannot search company directories, or find lists of state trademarks.

Another site is the State Directory Website. Depending on the state you should be able to search the database for that particular state only. These sites also do not include a list of federal trademarks or listings from other states.

Yellow Pages allow users to make nationwide searches by business name but again no intelligent searches are available.

Free searches for trademarks can be a big help in the process. Make sure you take advantage of all the free tools and resources you find along the way. If you are not satisfied with all your search results, your best bet is to go back to the trademark attorney idea and get thorough research done for you.

To avoid your application being rejected perform all the free trademark searches possible. Exhaust all your resources or go the attorney route. Be sure that your trademark is creative and unique and don't give up on your efforts.
